Note: Cash Pay Today/Pay It Today reserves the right at its discretion to change the terms of this User Agreement with or without notice. Your continued use of the Cash Pay Today/Pay It Today for Access Corrections website, Cash Pay Today/Pay It Today for Access Corrections Inmate CASH Deposit service or any other Cash Pay Today/Pay It Today service shall constitute your explicit agreement with the then current User Agreement and any other document referenced by the User Agreement. This User Agreement ("Agreement") is a contract between you and Cash Pay Today/Pay It Today and applies to your use of the Cash Pay Today/Pay It Today for Access Corrections Inmate CASH Deposit service (collectively the "Service"). This Agreement affects your rights and you should read it carefully. For additional information about the Service and how it works, please consult the Cash Pay Today/Pay It Today website at http://www.cashpaytoday.com or contact an Cash Pay Today/Pay It Today customer service representative at support@cashpaytoday.com or 1-844-340-CASH(2274) during normal business hours 8 am to 5 pm Eastern.

Notice - By submitting payment information through the Service you agree to the terms and conditions of this Agreement, the Cash Pay Today/Pay It Today Privacy Policy and any documents incorporated by reference. You further agree that this Agreement forms a legally binding contract between you and Cash Pay Today/Pay It Today, and that this Agreement constitutes a writing signed by you under any applicable law or regulation. Any rights not expressly granted herein are reserved by Cash Pay Today/Pay It Today. This Agreement is subject to change by Cash Pay Today/Pay It Today without prior notice (unless prior notice is required by law), by posting of the revised Agreement on the Cash Pay Today/Pay It Today website. In this Agreement, "You", "User" or "Customer" means any person or entity using the Service. The Pay It Today Inmate CASH deposit User may send funds (the "Payment") to an Cash Pay Today/Pay It Today Client (i.e. the correctional institution receiving funds on behalf of the inmate) in the United States in our payment locations with cash ONLY. Correctional facility staff has the authority to review, approve and reject all incoming payments. When required by applicable law, payments will be reported to federal, state or local authorities. You will be required to provide Cash Pay Today/Pay It Today with certain information to allow us, among other things: to verify your identity; and any other information Client shall require to send the Payment. Please refer to Cash Pay Today/Pay It Today Privacy Policy for information concerning Cash Pay Today/Pay It Today use of this information.

Facility Access User must agree that the correctional facility staff has the authority to review, approve and reject all incoming payments delivered by Cash Pay Today/Pay It Today. All users of Cash Pay Today/Pay It Today must be aware that all information, including but not limited to, payment, email, name and address is accessible by facility staff for review and approval. All users of Cash Pay Today/Pay It Today Inmate Cash deposit service acknowledge that correctional facility staff has the approval to use any and all information transmitted through Cash Pay Today/Pay It Today for investigative and legal purposes. Information transmitted through Cash Pay Today/Pay It Today can be used and distributed by personnel involved in the correctional industry, investigative (public and private) or public safety purposes, specifically the Department of Homeland Security and any other anti-terrorist agency (collectively “Law Enforcement”) Fees In consideration for the use of the Service, you agree to pay Cash Pay Today/Pay It Today a fee for each Payment sent by you at the applicable rate then in effect (the "Convenience Fee"). The applicable Convenience Fee for your Payment will be provided to you prior to your final authorization of the Payment, in addition to any applicable fees for additional services. All Service Fees are non-refundable. Payment Convenience Fees and the Payment amount are due and payable before Cash Pay Today/Pay It Today processes the Payment. You must pay for the Service by Cash. If Cash Pay Today/Pay It Today does not receive authorization from the cash acceptance location, the Payment will not be processed and funds will not be transmitted to the Client and will not be received.

Each time you use the Service you agree that Cash Pay Today/Pay It Today is authorized to charge for the principal Payment amount, the Convenience Fee, and any other applicable fees. Governing Law (a) In the event of any dispute, claim or controversy among the parties arising out of or relating to this Agreement that involves a claim by the User for less than $10,000, exclusive of interest, arbitration fees and costs, shall be resolved by and through arbitration administered by the American Arbitration Association ("AAA") under its Arbitration Rules for the Resolution of Consumer Related Disputes. Any other dispute, claim or controversy among the parties arising out of or relating to this Agreement shall be resolved by and through arbitration administered by the AAA under its Commercial Arbitration Rules. The arbitrability of the dispute, claim or controversy shall likewise be determined in the arbitration. The arbitration proceeding shall be conducted in as expedited a manner as is then permitted by the rules of the AAA. Both the foregoing Agreement of the parties to arbitrate any and all such disputes, claims and controversies, and the results, determinations, findings, judgments and/or awards rendered through any such arbitration shall be final and binding on the parties and may be specifically enforced by legal proceedings in any court of competent jurisdiction. (b) The arbitrator(s) shall follow any applicable federal law and Missouri State law in rendering an award. (c) Unless otherwise agreed by the parties in writing, the arbitration hearings shall take place in St. Louis Missouri USA. (d) The cost of the arbitration proceeding and any proceeding in court to confirm or to vacate any arbitration award, as applicable, including, without limitation, each party's attorneys' fees and costs, shall be borne by the unsuccessful party or, at the discretion of the arbitrator(s), may be prorated between the parties in such proportion as the arbitrator(s) determines to be equitable and shall be awarded as part of the arbitrator's award.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY OF THIS SITE IS PROVIDED BY Cash Pay Today/Pay It Today ON AN "AS IS" AND "AS AVAILABLE" BASIS. Cash Pay Today/Pay It Today MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS OR SERVICES INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR THE ACCURACY OF THE PERSONAL AND PAYMENT INFORMATION THAT YOU PROVIDE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, Pay It Today DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Cash Pay Today/Pay It Today DOES NOT WARRANT THAT THIS SITE, ITS SERVICES OR E-MAIL SENT FROM Cash Pay Today/Pay It Today ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Cash Pay Today/Pay It Today (AS WELL AS ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES AND STOCKHOLDERS) WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, ANY GOVERNMENT ENTITY'S NON-ACCEPTANCE OF A PAYMENT FROM A USER USING THIS SITE, FOR DISRUPTIONS IN SERVICE ON THIS SITE, OR FOR ERROR, DELAY OR MIS-DELIVERY OF A PAYMENT, REGARDLESS OF THE CAUSE, INCLUDING (WITHOUT LIMITATION) DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
